Receipt by email of an order confirmation does not automatically mean that Les Éditions CEC inc. (hereinafter “CEC”) accepts the order and is not confirmation that CEC undertakes to sell the products in question.
CEC reserves the right, on reasonable grounds, to limit the quantities available of one or more products sold and reserves the right to correct, cancel, reject or terminate at any time an order that has been confirmed or billed to your credit card. In that case, CEC will reimburse you any amount that may have been charged. CEC may, at any time, have to verify personal or credit card information prior to accepting an order.
An out-of-stock product is a product that is insufficient to completely fill an order. The product may be on order, missing or discontinued (if that is the case, you will be notified).
CEC lists all products that may be ordered. Please note that we do not necessarily have them in stock. If CEC has to wait for one or more out-of-stock items to become available, shipping of your order may be delayed.
Under no circumstances does CEC guarantee that the products offered on the Site will be available. You may cancel your order at any time prior to receipt by the Site of the out-of-stock product(s) by contacting CEC’s customer service. CEC shall not, under any circumstances, be liable for any damage you may suffer because a product is out of stock.
CEC and its affiliates make every effort to ensure that the information provided on the Site is accurate. However, CEC does not guarantee that the product descriptions or any other content of the Site is accurate, complete, reliable, up-to-date or error-free.
The prices of our products are in Canadian dollars and are net of applicable taxes. All orders, regardless of where they come from, are payable in Canadian dollars. CEC reserves the right to change its prices at any time. Products are always charged at the prices in effect at the time the order is registered.
CEC calculates the taxes based on the address to which the order will be shipped. For orders to be delivered within Canada, the taxes depend on the province; for example, for Quebec, the taxes added will be the G.S.T. (Goods and Services Tax) and the Q.S.T. (Quebec Sales Tax).
You must pay for your purchases by MasterCard or Visa, unless you already have an account with CEC. The customer agrees to pay the total cost and all applicable charges for the product purchased, including taxes. CEC may change the price after notifying the customer thereof. The customer alone is responsible for payment of the product purchased. The user alone is responsible for payment of the service offered by credit card. CEC is not liable for any payment problems related to the operation of the e-commerce service. In case of discrepancy between the price listed in the order confirmation and the price charged to the credit card, the latter shall prevail.
Delivery times depend on the destination and the delivery method chosen. Please allow for an additional two to five business days for processing, except for out-of-stock products. Note that you can follow the status of your order on the dashboard of your account.
All purchases of merchandise on CEC’s site are made pursuant to a shipping contract. That means that the risk of loss and the ownership of the merchandise are transferred to you when we hand the merchandise over to the carrier.
Returns and refunds
All sales are final. No refunds or returns.
Les Éditions CEC inc. operates the CEC web site (the “Site”). This agreement is a legal agreement between the user of the Site and Les Éditions CEC inc.
CAREFULLY READ ALL TERMS AND CONDITIONS PRIOR TO BROWSING OR REGISTERING ON THE SITE. By browsing the Site, or registering on the Site, you agree to be bound by the terms and conditions of this agreement. Access to and use of the Site are subject to full and unconditional compliance with these Terms of Use (hereinafter collectively the “Terms”). IF YOU WISH NOT TO BE BOUND BY THIS AGREEMENT, OR IF YOU DO NOT ACCEPT THE TERMS, DO NOT BROWSE THE SITE AND DO NOT REGISTER.
All content (texts, illustrations and images) reproduced on the Site are protected worldwide by copyright and intellectual property rights.
Unless specified otherwise in any of the sections of the Site, no element of the Site may be copied, reproduced, distributed, published, translated, downloaded, posted or sent in any manner whatsoever without the prior written permission of CEC or the copyright owner. You are permitted to post or download elements of the Site, but only for non-commercial purposes and provided you do not alter such elements and retain all intellectual property notices they contain. Any unauthorized use of such content could make you liable to a civil liability lawsuit and/or criminal proceedings.
The trade-marks and logos used or posted on the Site may be registered or unregistered trade‑marks of CEC or third parties. Nothing on the Site shall be construed as allowing, directly or indirectly, the use of a trade-mark reproduced on the Site without the prior written permission of the owner of the trade-mark in question.
If you are registered on the Site, you are responsible for keeping your identity, account and password confidential and limiting access to your computer, and you undertake to assume responsibility for any transactions in your account with your password. Should the confidentiality of the information be compromised, you must notify our service as soon as possible to avoid any fraudulent use of your identity. CEC is not liable for any loss or damage resulting from non-compliance with the security measures set out in this section.
You are advised to carefully read the section entitled “Limitation of liability” in these Terms of Use in order to take note of the extent of your responsibilities regarding the use of the Site.
This agreement concerning the terms of service shall be governed by the laws applicable in the Province of Quebec. You hereby acknowledge that any dispute arising from or related to the use of CEC’s services and Site shall be subject to the jurisdiction of the courts of the district of Montréal, Province of Quebec.
CEC and the elements contained on the Site are provided on an “as is” basis, without any warranty, whether express or implied. Subject to any public laws and regulations to the contrary, CEC hereby accepts no responsibility and gives no warranties, including, without limitation, warranties of merchantability or fitness for a particular purpose. In addition, CEC makes no representation regarding the use, downloading, validity, accuracy or reliability of the elements reproduced on the Site or with respect to the results arising from the use of such elements. Even though CEC makes every effort to ensure that the Site contains no errors, CEC accepts no responsibility for any errors on the Site. CEC’s affiliates, executives, employees, representatives or agents shall not, under any circumstances, be liable for any damage directly or indirectly related to the use of the Site, including, without limitation, any loss of data or profit arising from the use of the elements of the Site or inability to use such elements.
CEC shall not in any way be liable for any damages, including compensatory damages, whether direct or indirect, or any other damage whatsoever that may be caused to users or any other natural or legal person, by any technical equipment or technology whatsoever on the Site or any human or technical error that may occur at any stage whatsoever, for technical problems or defects in electronic or communications networks, online computer systems, servers, computer hardware, software, data transmissions or any other technical problem or internet congestion or other.
In the event that CEC is held liable towards you, such liability shall be limited to an amount of money equal to the price you paid for the returned products. Notwithstanding the foregoing, nothing in this section shall limit any rights you may have as a consumer under any public laws that may be applicable to your case.
CEC shall not be liable for the non-performance, in whole or in part, of any of its obligations to you, or any damage or loss you may suffer, if the non-performance, damage or loss occurs as a result of an event of force majeure or circumstances beyond its control.
